Terms of Service

Welcome to PaperChunk. These Terms of Service ("Terms") govern your access to and use of the PaperChunk platform, website at paperchunk.com, and all related services (collectively, the "Service") operated by Crowditory LTD ("we", "us", or "our").

By creating an account, subscribing to a plan, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Definitions

  • "Account" means the user account you create to access the Service.
  • "Server" or "Minecraft Server" means a virtual private server provisioned and managed through the PaperChunk platform for the purpose of hosting a Minecraft game server.
  • "Plan" means the subscription tier you select (e.g. Wood, Stone, Iron, Diamond, Netherite, Dragon), each with specified resource limits and pricing.
  • "Content" means any data, files, configurations, plugins, worlds, or other materials uploaded to or generated on your Server.
  • "User" or "you" means any individual or entity that accesses or uses the Service.

2. Eligibility

You must be at least 16 years of age to create an Account and use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent and warrant that you meet these eligibility requirements.

3. Account Registration

To use the Service, you must register for an Account by providing accurate information, including a valid email address. You are responsible for:

  • Maintaining the confidentiality of your Account credentials.
  • All activity that occurs under your Account.
  • Notifying us immediately at contact@paperchunk.com if you suspect unauthorized access to your Account.

We reserve the right to suspend or terminate Accounts that provide false information or violate these Terms.

4. Subscriptions and Payments

4.1 Plans and Pricing

The Service is offered through recurring monthly subscriptions. Each Plan provides specific resource allocations (CPU, RAM, player slots). Current pricing and Plan details are displayed on the Service at the time of purchase.

4.2 Billing

All payments are processed through Stripe. By subscribing to a Plan, you authorize us to charge your payment method on a recurring monthly basis. Prices are displayed in Euros (EUR) and may be subject to applicable taxes.

4.3 Cancellation

You may cancel your subscription at any time through the Billing page. Upon cancellation:

  • Your Server remains active until the end of the current billing period.
  • After the billing period ends, your Server will be suspended. Data will be retained for a grace period of up to 14 days.
  • After the grace period, your Server and all associated data may be permanently deleted.

4.4 Refunds

Payments are generally non-refundable. However, if you experience a significant service issue that we are unable to resolve, you may contact us at contact@paperchunk.com to discuss a refund on a case-by-case basis. We reserve the right to issue refunds or credits at our sole discretion.

4.5 Price Changes

We may change Plan pricing at any time. Price changes will be communicated via email at least 30 days in advance and will apply at the start of your next billing cycle. If you do not agree with a price change, you may cancel your subscription before the new price takes effect.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with all applicable laws. You must not:

  • Use the Service to host, distribute, or facilitate any illegal content, including but not limited to pirated software, malware, or content that violates intellectual property rights.
  • Engage in denial-of-service attacks, network abuse, port scanning, or any activity that disrupts or damages the Service, our infrastructure, or other users' servers.
  • Use the Server for purposes other than hosting a Minecraft server (e.g. cryptocurrency mining, hosting unrelated web services, running botnets, proxy services, or VPNs).
  • Attempt to circumvent resource limits, access other users' servers, or exploit vulnerabilities in the Service.
  • Engage in harassment, threats, hate speech, or any behavior that creates a hostile environment for other users.
  • Run server plugins or modifications that are designed to harm, cheat, or exploit other players or the underlying infrastructure.
  • Resell, sublicense, or commercially redistribute access to the Service without our prior written consent.
  • Upload or install plugins or files that contain malicious code, backdoors, or security vulnerabilities.

We reserve the right to suspend or terminate your Account and Server without notice if we determine, at our sole discretion, that you are violating these acceptable use requirements.

6. Server Management

6.1 Provisioning

When you subscribe to a Plan, we provision a dedicated virtual server on your behalf. The server is configured with resources corresponding to your selected Plan. Server provisioning typically completes within 5-10 minutes.

6.2 Resource Limits

Each Plan has defined resource limits (CPU cores, RAM, maximum players). These limits are enforced automatically. If your server consistently exceeds its resource allocation, you may experience degraded performance. We recommend upgrading to a higher Plan to accommodate growing needs.

6.3 Plugins and Modifications

You may install Minecraft server plugins through the PaperChunk panel, including from our curated catalog, Modrinth, or via manual upload (if enabled by the administrator). You are solely responsible for the plugins you install and their compliance with applicable licenses and laws.

6.4 Backups

We do not guarantee automatic backups of your Server data. You are responsible for maintaining your own backups of important world data, configurations, and plugins. We strongly recommend regularly downloading backups of your Minecraft world.

7. Your Content

You retain ownership of all Content you upload to or create on your Server. By using the Service, you grant us a limited, non-exclusive license to store, process, and transmit your Content solely for the purpose of providing the Service.

You are solely responsible for ensuring that your Content does not violate any laws, third-party rights, or these Terms. We do not monitor your Content but reserve the right to remove Content that violates these Terms.

8. In-Game Store (Tebex Integration)

The Service allows you to connect a Tebex store to your Minecraft server. If you operate an in-game store:

  • You are solely responsible for your store's compliance with all applicable laws, including consumer protection, taxation, and Tebex's own terms of service.
  • We are not a party to transactions between you and your players. We do not process, hold, or have access to funds from your Tebex store.
  • You must not sell items, ranks, or services that violate the Minecraft End User License Agreement (EULA) or any applicable regulations.

9. Intellectual Property

The PaperChunk name, logo, website design, platform code, and all related intellectual property are owned by Crowditory LTD. You may not copy, modify, distribute, or create derivative works based on our intellectual property without our prior written consent.

Minecraft is a trademark of Mojang Studios / Microsoft Corporation. PaperChunk is not affiliated with, endorsed by, or sponsored by Mojang Studios or Microsoft Corporation.

10. Service Availability and Disclaimers

10.1 Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, infrastructure provider issues, or circumstances beyond our control (force majeure).

10.2 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR SECURE.

10.3 Infrastructure

Servers are hosted on third-party infrastructure (Hetzner Cloud). While we carefully select our infrastructure providers, we are not responsible for outages, data loss, or performance issues caused by the underlying infrastructure provider.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CROWDITORY LTD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Crowditory LTD and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your Content or your operation of an in-game store.
  • Your violation of any applicable law or third-party rights.

13. Suspension and Termination

13.1 By You

You may cancel your subscription and close your Account at any time. Cancellation takes effect at the end of your current billing period.

13.2 By Us

We may suspend or terminate your Account and Server immediately and without prior notice if:

  • You materially breach these Terms, including the Acceptable Use policy.
  • Your payment method fails and cannot be resolved within a reasonable period.
  • We are required to do so by law or regulatory authority.
  • Your Server is being used in a manner that threatens the stability or security of our infrastructure.

13.3 Effect of Termination

Upon termination, your Server will be shut down and your data will be retained for up to 14 days to allow you to retrieve it. After this period, all data associated with your Server may be permanently and irreversibly deleted.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or through a notice on the Service at least 14 days before they take effect. Your continued use of the Service after the changes take effect constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service and cancel your subscription.

15. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

17. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Crowditory LTD regarding the Service and supersede all prior or contemporaneous agreements.
